These Terms and Conditions (“Terms”) govern your access to and use of the LOAM LLC (“LOAM,” “we,” “our,” or “us”) website, mobile applications, and related services (collectively, the “Site”). By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree with these Terms, you may not use the Site.

Use of the Site
LOAM provides a curated online marketplace that connects customers with sustainable lifestyle products offered by third-party vendors and suppliers. You agree to use the Site only for lawful purposes and in accordance with these Terms. You are responsible for all activity conducted under your account.

Indemnification

Arbitration and Dispute Resolution
Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any products purchased through the Site shall be resolved by binding arbitration in Maricopa County, Arizona, administered by the American Arbitration Association under its Commercial Arbitration Rules. You and LOAM agree to waive any right to a jury trial or to participate in a class action. Notwithstanding the foregoing, either party may seek injunctive or equitable relief in state or federal court in Maricopa County, Arizona.

Governing Law
These Terms and your use of the Site shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to conflict of law principles.

Force Majeure
LOAM shall not be held liable or responsible for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, labor disputes, supply chain disruptions, governmental actions, or interruptions in internet or telecommunications services.

Termination
LOAM reserves the right to suspend or terminate your access to the Site at any time, with or without cause or notice, including if you violate these Terms. Upon termination, all provisions of these Terms that by their nature should survive will remain in effect, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Changes to These Terms
We may update these Terms from time to time at our discretion. Any changes will be posted on this page with an updated effective date. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
