Welcome to LOAM. These Terms of Service (“Terms”) govern your access to and use of our website, shop, products, services, and related features (collectively, the “Services”).

Throughout these Terms, “LOAM,” “we,” “us,” and “our” refer to LOAM LLC. “You” refers to any person accessing or using our Services.

By visiting our website, creating an account, or purchasing from LOAM, you agree to these Terms. If you do not agree, please do not use the Services.

1. About LOAM

LOAM is a curated online marketplace bringing together products selected with consideration for personal wellness, materials, environmental impact, and responsible production.

Many products available through LOAM are manufactured, stocked, and fulfilled directly by independent brand partners. As a result, products within a single order may be shipped separately, arrive at different times, or have different return destinations.

LOAM remains your point of contact for purchases made through our website.

2. Online Store Terms

You must be at least the age of majority in your state or place of residence to make a purchase through LOAM, or have permission from a parent or legal guardian.

You may not use our Services or products for any unlawful or unauthorized purpose or violate any applicable law in connection with your use of the Services.

We reserve the right to refuse service, cancel orders, limit quantities, or restrict access to the Services when reasonably necessary, including in cases of suspected fraud, misuse, pricing errors, inventory errors, or violation of these Terms.

3. Products + Product Information

We make reasonable efforts to present product descriptions, photographs, materials, ingredients, dimensions, colors, certifications, pricing, and other information as accurately as possible.

Because many products are supplied by independent brand partners, some product information is provided directly by those brands. Product formulations, materials, packaging, colors, specifications, availability, and other details may change without notice.

We encourage you to review product labels, ingredient lists, materials, care instructions, warnings, and other information included with the product before use, particularly if you have allergies, sensitivities, dietary restrictions, or other individual considerations.

Colors and appearance may also vary based on your screen or device.

4. LOAM's Curation Standards

LOAM seeks to curate products that align with our standards and broader mission around thoughtful materials, personal wellness, and environmental responsibility.

Terms such as “natural,” “clean,” “organic,” “non-toxic,” “sustainable,” “plastic-free,” “low-plastic,” or similar descriptions may have different definitions depending on the product, certification, manufacturer, or context.

When we reference certifications or specific product attributes, we rely in part on information provided by our brand partners and manufacturers. Unless specifically stated, LOAM does not independently certify products.

We encourage customers to review individual product information to determine whether a product meets their personal standards and needs.

5. Pricing + Availability

Prices and product availability are subject to change without notice.

We reserve the right to correct errors in product descriptions, pricing, promotions, shipping charges, availability, or other information and to cancel or modify an order if information was inaccurate at the time the order was placed.

If we cancel an order after payment has been collected, the applicable amount will be refunded.

Certain products may be available only in limited quantities or for limited periods.

6. Orders

Submitting an order does not guarantee acceptance of the order.

We may cancel or limit an order for reasons including:

• Inventory discrepancies
• Pricing or listing errors
• Suspected fraud or unauthorized activity
• Shipping restrictions
• An inability by a fulfillment partner to complete the order

If we are unable to fulfill an item for which you have already paid, we will issue the appropriate refund.

You agree to provide current, complete, and accurate billing, shipping, account, and contact information when making a purchase.

7. Payment + Taxes

You agree to provide valid payment information and authorize us and our payment-processing providers to charge the amounts associated with your order.

Applicable sales tax and other required taxes or charges will be calculated as required by applicable law.

Payments may be processed using third-party payment providers, including services made available through Shopify.

8. Shipping + Fulfillment

Many LOAM products are shipped directly from the independent brand partner that fulfills the product.

An order containing products from multiple brands may arrive in multiple packages and on different dates.

Shipping estimates are estimates rather than guarantees. Delivery times may be affected by carriers, weather, holidays, fulfillment delays, incorrect addresses, and circumstances outside our reasonable control.

9. Returns + Refunds

Eligible products may be returned according to our Return & Refund Policy.

Certain products may be designated Final Sale or Non-Returnable, including products for which a return would be inappropriate because of hygiene, safety, perishability, customization, product integrity, or other considerations.

Customers must initiate eligible returns through their LOAM account and follow the return instructions provided.

Because many orders are fulfilled directly by our brand partners, products may need to be returned directly to the applicable fulfillment partner rather than to LOAM.

Please do not send a product to LOAM or to an address from the original shipment unless your return instructions specifically direct you to do so.

Our Return & Refund Policy is incorporated into these Terms.

10. Damaged, Defective, Missing, or Incorrect Orders

If an item arrives damaged, defective, incomplete, or incorrect, please notify us promptly through the applicable order or return process.

We may request photographs, packaging information, or other reasonable documentation to help us and the fulfillment partner resolve the issue.

Resolution may include replacement, refund, partial refund, or another appropriate remedy depending on the circumstances and product availability.

Nothing in these Terms limits rights or remedies that cannot legally be limited under applicable consumer-protection laws.

11. Personal + Wellness Information

Content provided through LOAM, including product descriptions, articles, guides, social media content, emails, and other educational materials, is provided for general informational purposes.

Unless expressly stated otherwise, LOAM does not provide medical advice and our content is not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Statements relating to wellness, health, ingredients, materials, or product benefits should not be treated as a substitute for advice from an appropriately qualified healthcare professional.

12. Intellectual Property

Unless otherwise indicated, the LOAM name, branding, website design, written content, graphics, logos, photographs created by LOAM, collections, guides, and other original materials are owned by or licensed to LOAM and are protected by applicable intellectual-property laws.

Brand names, trademarks, product photographs, and other materials belonging to our brand partners remain the property of their respective owners.

You may use our website for personal, non-commercial purposes. You may not reproduce, distribute, modify, sell, republish, scrape, exploit, or commercially use our content without prior written permission.

13. Reviews + User Content

If you submit a product review, photograph, comment, testimonial, or other content to LOAM, you represent that you have the right to submit that content and that it does not violate the rights of another person.

You grant LOAM a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute content you voluntarily submit in connection with operating and promoting LOAM and our Services, subject to applicable law.

We may remove content that is unlawful, fraudulent, abusive, misleading, infringing, or otherwise inappropriate.

14. Prohibited Uses

You may not use the Services to:

• Violate any applicable law or regulation
• Infringe intellectual-property or other legal rights
• Submit false, misleading, or fraudulent information

Products may also be subject to warranties, guarantees, instructions, or disclaimers provided by their respective manufacturers.

Nothing in this section excludes warranties or consumer rights that cannot legally be excluded.

To the fullest extent permitted by applicable law, LOAM will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of the Services or products purchased through the Services.

LOAM's liability for any claim relating to a particular purchase will not exceed the amount you paid to LOAM for the product giving rise to the claim, except where applicable law requires otherwise.

These Terms and any disputes arising from your use of the Services will be governed by the applicable laws of the State of Arizona and applicable federal law, without regard to conflict-of-law principles, except where applicable consumer-protection law provides otherwise.
